6. i. We have made all reasonable efforts to accurately display the colours, designs and sizes of the goods for sale on our Website. By subsequently placing an order, you acknowledge and accept that designs, colours, shapes and patterns shown on the Website are best replication only. Colours in particular may differ due to your own computer's visual settings and hardware and the colour definition displayed is beyond our control.

If the goods you have ordered are not available in the colour, design, size or specification you have requested we will notify you of the colours, designs, sizes and specifications currently available. 9. i. The retail price indicated for the goods shown on the Website include UK Value Added Tax (VAT).
10. ii The trade price (excluding VAT at the prevailing rate) is published separately and is a private and confidential document that is not permitted for public and general non-trade publication.
11. iii. For orders placed outside of the EU, it is the purchaser’s responsibility to prove that they are situated outside of the EU. VAT will be charged but then refunded on proof of delivery location outside of the EU.
12. iv. Individual countries have their own levels of Import Duty. It is the responsibility of the purchaser to satisfy themselves that the product(s) purchased from Marksman Wholesale’s Website is not dutifully bound to any further duty or tax. The responsibility for payment of any levy/import duty or tax liable is the sole responsibility of the purchaser.
13. v. Payment shall be made by you under the terms that have been agreed between Marksman Wholesale Ltd and your organisation. Ownership of the goods remains with Marksman Wholesale Ltd until all cleared funds have been received in our bank account. If your order is not a ‘special order’ on the factory and neither subject to special manufacturing timescales and/or extended delivery, you may cancel your order at any time up to the date of despatch. You may return un-opened and un-used goods but only providing the goods remain sealed in their original packaging in a condition deemed ‘as new’ and suitable and able to be re-sold. If there are any elements of the original packaging missing, such as, (but not limited to) outer sleeves & other packaging etc then we reserve the right to charge a 10% restocking fee.
15. ii. To cancel your order, you must notify us in writing (posted letter or email) up to 24-hours prior to shipping.
16. iii. Unless the Goods are faulty, we reserve the right to recover any and all direct costs incurred by us in recovering any or all goods from you and we may set such costs off against any credit amount due back to you. Any deposits paid to temporarily hold goods are non-refundable after 30 days of payment should you wish to cancel the order or immediately after the item has arrived in stock or if Marksman Wholesale Ltd has incurred costs in obtaining the stock once it has been delivered. 29. vi. We shall have no liability to you for any consequential, special or indirect losses including (but not limited to) loss of revenues, profits, contracts, business or anticipated savings, damage to or loss of goodwill, reputation or data.
30. vii. Without prejudice, our total aggregate liability to you arising in relation to any transaction shall not exceed the amount paid by you for the goods subsequently ordered in that transaction.

We shall have no liability to you for any failure in delivering goods or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control such as, (but not limited to) industrial action or other disputes, breakdown of IT systems, flood, fire, explosion, natural occurrences or accident.
